LINUX FOUNDATION EVENT CODE OF CONDUCT
The Linux Foundation is dedicated to providing a harassment-free experience for participants at all of our events, whether they are held in person or virtually. The Linux Foundation events are working conferences intended for professional networking and collaboration in the Linux community. They exist to encourage the open exchange of ideas and expression and require an environment that recognizes the inherent worth of every person and group. While at The Linux Foundation events, in person or virtual, or related ancillary or social events, any participants, including speakers, attendees, volunteers, sponsors, exhibitors, booth staff and anyone else, should not engage in harassment in any form.

PHOTO & VIDEO RELEASE
By registering to attend the event, you hereby consent to the photographing of yourself and the recording of your voice and the use of these photographs and/or recordings singularly or in conjunction with other photographs and/or recordings for advertising, publicity, commercial or other business purposes for The Linux Foundation. You understand that the term "photograph" as used herein encompasses both still photographs and motion picture footage.

ACCEPTANCE OF RISK; LIMITATION OF LIABILITY; WAIVER OF CLAIMS
BY REGISTERING TO ATTEND THE EVENT, AND/OR BY ATTENDING THE EVENT, YOU ACKNOWLEDGE THAT NOTWITHSTANDING THE COVID-19 PROTOCOLS FOR THE EVENT, IT IS NOT POSSIBLE TO GUARANTEE (1) THAT ALL ATTENDEES WILL STRICTLY COMPLY AT ALL TIME WITH THE COVID-19 PROTOCOLS; OR (2) THAT YOU WILL NOT BECOME INFECTED WITH COVID-19 DURING THE EVENT. YOU AGREE THAT YOU ACCEPT THE ENTIRETY OF THE RISK RELATING TO YOUR ATTENDANCE AT THE EVENT, INCLUDING WITHOUT LIMITATION THE POSSIBILITY OF ANY DAMAGES (INCLUDING ILLNESS OR DEATH) THAT MAY RESULT FROM YOUR ATTENDANCE AT THE EVENT OR FROM YOUR INTERACTIONS WITH EVENT STAFF OR OTHER ATTENDEES.

UNDER NO CIRCUMSTANCES WILL THE LINUX FOUNDATION BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES RELATING TO EXPOSURE, INFECTION OR SPREAD OF COVID-19 THAT RESULT FROM YOUR ATTENDANCE AT THE EVENT.

BY REGISTERING TO ATTEND THE EVENT, AND/OR BY ATTENDING THE EVENT, YOU AGREE THAT TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LINUX FOUNDATION WILL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, THAT OCCUR AS A RESULT OF YOUR ATTENDANCE AT THE EVENT, INCLUDING WITHOUT LIMITATION THOSE RESULTING FROM LOSS OF OR DAMAGE TO PERSONAL PROPERTY, PERSONAL INJURY, ILLNESS, OR DEATH, INCLUDING ANY OF THE FOREGOING WITH REGARDS TO COVID-19. IF THE FOREGOING LIMITATION IS NOT ENFORCEABLE UNDER APPLICABLE LAW, THEN YOU AGREE THAT THE LIABILITY OF THE LINUX FOUNDATION WILL IN NO CASE EXCEED THE AMOUNT YOU PAID FOR YOUR ADMITTANCE TO THE EVENT. THE FOREGOING LIMITATIONS OF LIABILITY ARE AN ESSENTIAL BASIS OF THE LINUX FOUNDATION’S DECISION TO OFFER THE EVENT, AND SHALL APPLY REGARDLESS OF THE LEGAL THEORY UPON WHICH DAMAGES MAY BE CLAIMED; REGARDLESS OF WHETHER A PARTY KNEW OR
SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES; AND REGARDLESS OF WHETHER THE FOREGOING LIMITATIONS OF LIABILITY CAUSE ANY REMEDY TO FAIL IN ITS ESSENTIAL PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, YOU ACCEPT AND ASSUME ALL RISKS OF ANY AND ALL PERSONAL INJURY OR DAMAGE TO YOUR PERSONAL PROPERTY THAT YOU MAY FACE WHILE ATTENDING THE EVENT. YOU HEREBY RELEASE THE LINUX FOUNDATION AND ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, LICENSORS, SPONSORS, SUCCESSORS AND ASSIGNS FROM, AND WAIVE, ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, SUITS, DAMAGES, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEYS’ FEES AND COSTS) THAT YOU MAY HAVE NOW OR IN THE FUTURE, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN, ASSOCIATED IN ANY WAY WITH THE EVENT.
